The following policies were
designed to ensure your satisfaction and understanding of the purchase process
at The Sports Nook Inc. (“Sports Nook)
AGREEMENT OF TERMS:
By visiting, using or ordering from this website, you expressly agree to
be bound by the following Terms and Conditions and to adhere to these Terms and
Conditions and all applicable laws and regulations governing this website.
If you break these Terms and Conditions, Sports Nook
reserves the right to cancel your ticket order, prevent your future use of this
website and/or take appropriate legal action and remedies available against
you.
TICKET PURCHASE POLICY:
All orders are subject to ticket availability. Sports
Nook agrees to use its best efforts to procure and to
deliver, prior to the date of the event, the tickets as described and ordered. Sports
Nook also reserves the right to replace tickets with
comparable and/or upgraded tickets if original tickets are not available.
Definitions of "comparable" and "upgraded" are to be
determined at the sole discretion of Sports Nook.
Should Sports Nook fail to deliver to a Purchaser
the full quantity of tickets ordered, Sports Nook’s sole obligation and/or liability shall be limited to the return to Purchaser
of any deposits and/or payments for undelivered tickets previously made by Purchaser
to Sports Nook under this Agreement. Sports
Nook reserves the right to cancel and/or refund the Purchaser’s
order at any time and for any reason.
Due to the large volume of ticket sellers listing
tickets on our site, on very rare occasion pricing errors do occur. Because Sports
Nook sometimes acts as an agent between the original
purchaser of the tickets and the end user of the tickets, Sports
Nook shall not be liable for any pricing errors listed
on this website. Furthermore, Sports Nook does not guarantee any information provided by our licensed sellers in
the 'Note' area of the ticket listings.
Due to the large volume of ticket sellers listing
tickets on our site, locations, descriptions and pricing of similar and/or
equal tickets may vary. It will be the Purchaser’s responsibility to verify any
possible inconsistency and/or discrepancy in the ticket location, description,
and/or price by calling Sports Nook at 866-323-8785 before the order is placed. Once an order is placed, Sports
Nook will only accept returns for gross
misrepresentations of the tickets described.
REFUND POLICY:
All sales are final. A full refund of the purchase price will be given
for canceled events only. Shipping charges are non-refundable. Refunds for
canceled events must be requested within 30 days of the event cancellation.
Postponed or rescheduled events will not be refunded.
Please note that we are not always notified if a
show is postponed, rescheduled, or canceled. It will be the buyer's
responsibility to confirm any changes to the date or time of the show with the
sponsor.
DELIVERY OF TICKETS:
Due to the nature of the ticket industry, we do reserve the right to
deliver tickets for any order as late as the day of the event. Last minute
delivery service for delivery the day of the event may include but are not
limited to: Will Call at the venue box office, courier, and/or email. If
tickets have not been delivered within two days before the date of the event,

Please keep your tickets in a safe place. Sports
Nook is not responsible for lost, stolen, damaged and/or
destroyed tickets. Please note that direct sunlight or heat can damage certain
types of tickets.
WARRANTY
The
following constitutes the entire and exclusive warranty to Purchaser:
Sports
Nook warrants all orders and sales for a period of six (6) weeks from the date
of confirmation by Sports Nook to Purchaser of the procurement of Purchaser’s
tickets. If any part or portion of the
order or sale fails as a result of Sports Nook’s handling of the order, including
shipment of any tickets to Purchaser after confirmation by Sports Nook to
Purchaser of same, Sports Nook agrees to replace Purchaser’s order with tickets
of equal or greater value to the same event at Sports Nook’s expense, including
labor and shipping charges associated therewith.
INDEMNITY:
Purchaser
agrees to indemnify and hold harmless Sports Nook and its affiliates,
subsidiaries, assigns, officers, directors, employees, representatives and/or
agents, against any claim and/or demand by a third party, and all costs and
expenses, including but not limited to reasonable attorneys’ fees, incurred
therein, arising out of any claim and/or demand by a third party involving,
pertaining to and/or relating to negligence of Sports Nook (excluding gross negligence
and/or recklessness); the purchase, sale and/or transfer of tickets; any action
associated with this website; actions and/or admissions of Sports Nook; the
business of Sports Nook; any alleged breaches of any agreement, warranty or
contract by Purchaser; or Purchaser’s violation of any law, ordinance,
regulation or right of a third party, including but not limited to the
negligence of Purchaser (excluding gross negligence and/or recklessness).
LIMITATIONS
Sports Nook provides no warranties
not expressly stated herein. Sports Nook
makes no warranties relating to its services, ticket sales and/or website, not
expressly provided herein.
This warranty is in lieu of, and Sports Nook expressly disclaims,
all other warranties not provided herein, whether express or implied, stated or
unstated, known or unknown, statutory or otherwise, including but not limited
to warranties of merchantability, title, non-infringement of third party rights
and/or fitness for a particular purpose.
In no event shall Sports Nook assume any liability for direct,
indirect, special, incidental, exemplary, and/or consequential damages of any
kind whatsoever, including but not limited to lost profits and business
interruption, resulting from Sports Nook’s services provided and/or Purchaser’s
use of Sports Nook’s services, including but not limited to the website, orders
and/or ticket sales.
To the extent your jurisdiction does
not allow for the exclusion of implied warranties or limitation on implied
warranties, or the exclusion or limitation of incidental or consequential
damages, some of the aforementioned exclusions/limitations may not apply to
you; such exclusions/limitations are void where prohibited. Otherwise, all exclusions/limitations noted
herein apply to the fullest extent of the law in your jurisdiction.
REMEDY:
Purchaser’s
sole and exclusive remedy is return of the ticket price on any order at issue.
A non-purchaser(s) sole and exclusive remedy
under this order is $100, or the total amount of all tickets purchased and/or
sold by non-purchaser via Sports Nook for a one (1) year period from the day a
claim and/or demand is made to Sports Nook, which ever amount is less.
If Purchaser’s remedy as stated
herein is determined to fail of its essential purpose by a court of component
jurisdiction, Sports Nook’s responsibility and/or liability shall not exceed
one times the net purchase price of the order stated herein.
MISCELLANEOUS:
Purchaser
and Sports Nook agree that all disputes arising out of this order must be

any provision of this Warranty be deemed invalid and/or unenforceable by a
court of law, the remaining terms and conditions herein shall continue unabated
in full force and effect.

terms and conditions contained herein shall be governed by and construed under

Warranty represents the entire agreement between the Purchaser and Sports Nook
with respect to the subject matter herein and supersedes all prior and/or
contemporaneous oral or written communications, representations,
correspondence, understanding and/or agreements relating to an order.
Upon confirmation by Sports Nook of
Purchaser’s order, all sales are final and no refunds or exchanges will be
permitted without the express written consent of Sports Nook. However, full refund of the purchase price
will be given for canceled events only. Shipping charges are non-refundable.
Refunds for canceled events must be requested within 30 days of the event cancellation.
Postponed and/or rescheduled events will not be refunded. Should Purchaser disagree with and/or oppose the
inclusion of any term of this purchase order, Purchaser must notify Sports
Nook, in writing, within five (5) days of the date of receipt of this purchase
order, regarding said disagreement or opposition, or such disagreement or
opposition is waived.

We accept Visa, Mastercard, Discover, American Express, PayPal and Google
Checkout.
NON-AFFILIATIONS
Sports Nook is an independent, privately
owned company engaged in the business of buying and selling tickets at a
premium for sporting events, concerts, and theatre. Sports Nook is in no way affiliated with any box office or official organizers (e.g.
FIFA, ATP, NBA, NCAA, etc) of the events for which we list tickets. Tickets are
sold for market value which is often above the face value printed on the
ticket.
CHANGES IN TERMS & CONDITIONS:
Sports Nook reserves the right to change these Terms and Conditions at any time.
Posting updated Terms and Conditions on this site will make the new Terms and
Conditions effective immediately and binding on all users of this website
without exception from the date of posting forward. Therefore, please check
this page of the website periodically for updates.
